We provide work-finding services to Our clients and work-seekers. In order to provide these services, ES must process personal data, including sensitive personal data. You may give Us your personal details directly, i.e. on a registration form or via our Website or Staff Portal. We may also collect your personal information indirectly from other sources, such as Jobs Board, for the purposes of providing you with work-finding services and/or information relating to roles relevant to you.

We will collect your personal data, which may include sensitive personal data, via Our website, Staff Portal, telephone, job boards, other sources such as referee details. We will process your personal data for the purposes of providing you with work-finding services. We must have a legal basis for processing your personal data. Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

Your personal data is required by law and/or a contractual requirement (i.e. Our client may require this personal data), and/or a requirement necessary to enter into a contract. You are obliged to provide the personal data and if you do not the consequences of failure to provide the data include failure to provide you with the interested position/role you have applied for.

How we store your personal information

Your information is securely stored.

We will retain your personal data only for as long as is necessary. Different laws require us to keep different data for different periods of time.

Employment law requires that the data you share might be with your employers for a number of years.

We must also keep your payroll records, holiday pay, sick pay and pensions auto-enrolment records for as long as is legally required by HMRC and associated national minimum wage, social security and tax legislation.

Where We have obtained your consent to process your personal data, we will do so in line with Our retention policy. Upon expiry of that period, We will seek further consent from you. Where consent is not granted, We will cease to process your personal data and sensitive personal data.

Where you have exercised the right to be forgotten, We will do this in line with Our retention policy. Your data may not be deleted in its entirety, it may be archived to meet the requirements of the retention policy. If your data is archived it will not be available for processing by any of Our team member.

It is important to note that if you request that your data be deleted, in the case that data is archived, and you want to re-register in the future, We will not be able to retrieve your information from archive. You will be required to complete the registration process from the beginning. It should be considered to put your data on hold as opposed to requesting to delete, if you think you may begin work-seeking activities again in the future.
